Elsevier NIH Policy Statement

As a service to our authors, Elsevier will deposit to PubMed Central (PMC) author manuscripts on behalf of Elsevier authors reporting NIH funded research. This service is a continuation of Elsevier’s 2005 agreement with the NIH when the NIH introduced their voluntary ‘Public Access Policy.’
The service will help authors comply with the National Institutes of Health (NIH) revised ''Public Access Policy,'' effective April 7, 2008. The NIH’s revised policy requires that NIH-funded authors submit to PubMed Central (PMC), or have submitted on their behalf, their peer-reviewed author manuscripts, to appear on PMC no later than 12 months after final publication.

Who are STM Members?

STM is an international association of about 100 scientific, technical, medical and scholarly publishers, collectively responsible for more than 60% of the global annual output of research articles, 55% of the active research journals and the publication of tens of thousands of print and electronic books, reference works and databases. We are the only international trade association equally representing all types of STM publishers - large and small companies, not for profit organisations, learned societies, traditional, primary, secondary publishers and new entrants to global publishing. STM is run by and for our members and all members irrespective of size and for- or not-for-profit status are eligible to vote and be full members of STM’s governing Board.

Mr. LIEBERMAN (for himself and Mr. CORNYN) introduced the following bill; which was read twice and referred to the Committee on Homeland Security and Governmental Affairs A BILL To provide for Federal agencies to develop public access policies relating to research conducted by employees of that agency or from funds administered by that agency.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Federal Research Public Access Act of 2009'.

SEC. 2. FINDINGS.

Congress finds that--

(1) the Federal Government funds basic and applied research with the expectation that new ideas and discoveries that result from the research, if shared and effectively disseminated, will advance science and improve the lives and welfare of people of the United States and around the world; and

(2) the Internet makes it possible for this information to be promptly available to every scientist, physician, educator, and citizen at home, in school, or in a library.

SEC. 3. DEFINITION.

In this Act the term `Federal agency' means an Executive agency defined under section 105 of title 5, United States Code.

SEC. 4. FEDERAL RESEARCH PUBLIC ACCESS POLICY.

(a) In General- Not later than 1 year after the date of enactment of this Act, each Federal agency with extramural research expenditures of over $100,000,000 shall develop a Federal research public access policy that is consistent with and advances purposes of the Federal agency.

(b) Content- Each Federal research public access policy shall provide for--

(1) submission to the Federal agency of an electronic version of the author's final manuscript of original research papers that have been accepted for publication in peer-reviewed journals and result from research supported, in whole or in part, from funding by the Federal Government;

(2) the incorporation of all changes resulting from the peer review publication process in the manuscript described under paragraph (1);

(3) the replacement of the final manuscript with the final published version if--

(A) the publisher consents to the replacement; and

(B) the goals of the Federal agency for functionality and interoperability are retained;

(4) free online public access to such final peer-reviewed manuscripts or published versions as soon as practicable, but not later than 6 months after publication in peer-reviewed journals;

(5) production of an online bibliography of all research papers that are publicly accessible under the policy, with each entry linking to the corresponding free online full text; and

(6) long-term preservation of, and free public access to, published research findings--

(A) in a stable digital repository maintained by the Federal agency; or

(B) if consistent with the purposes of the Federal agency, in any repository meeting conditions determined favorable by the Federal agency, including free public access, interoperability, and long-term preservation.

(1) apply to--

(A) researchers employed by the Federal agency whose works remain in the public domain; and

(B) researchers funded by the Federal agency;

(2) provide that works described under paragraph (1)(A) shall be--

(A) marked as being public domain material when published; and

(B) made immediately available under subsection (b)(4); and

(3) make effective use of any law or guidance relating to the creation and reservation of a Government license that provides for the reproduction, publication, release, or other uses of a final manuscript for Federal purposes.

(d) Exclusions- Each Federal research public access policy shall not apply to--

(1) research progress reports presented at professional meetings or conferences;

(2) laboratory notes, preliminary data analyses, notes of the author, phone logs, or other information used to produce final manuscripts;

(3) classified research, research resulting in works that generate revenue or royalties for authors (such as books) or patentable discoveries, to the extent necessary to protect a copyright or patent; or

(4) authors who do not submit their work to a journal or works that are rejected by journals.

(e) Patent or Copyright Law- Nothing in this Act shall be construed to affect any right under the provisions of title 17 or 35, United States Code.

(f) Report-

(1) IN GENERAL- Not later than October 1, of each year, the head of each Federal agency shall submit a report on the Federal research public access policy of that agency to--

(A) the Committee on Homeland Security and Governmental Affairs of the Senate;

(B) the Committee on Oversight and Government Reform of the House of Representatives;

(D) the Committee on Commerce, Science, and Transportation of the Senate;

(E) the Committee on Health, Education, Labor, and Pensions of the Senate; and

(F) any other committee of Congress of appropriate jurisdiction.

(2) CONTENT- Each report under this subsection shall include--

(A) a statement of the effectiveness of the Federal research public access policy in providing the public with free online access to papers on research funded by the Federal agency;

(B) a list of papers published in peer-reviewed journals that report on research funded by the Federal agency;

(C) a corresponding list of papers made available by the Federal agency as a result of the Federal research public access policy; and

(D) a summary of the periods of time between public availability of each paper in a journal and in the online repository of the Federal agency.

(3) PUBLIC AVAILABILITY- The Federal agency shall make the statement under paragraph (2)(A) and the lists of papers under subparagraphs (B) and (C) of paragraph (2) available to the public by posting such statement and lists on the website of the Federal agency.

Enhancing the Debate on Open Access
A joint statement by the International Federation of Library Associations and Institutions and the International Publishers Association

The debate about open access in scholarly communication is an important opportunity for the international library and publishing communities to explore how technology and new business models can resolve the challenge of growing scholarly publishing output which puts pressure on publisher prices and library resources. IFLA and IPA welcome the widespread attention this extremely important issue has received. The debate has, however, occasionally been harmed by unnecessary polarisations and sweeping generalised statements.

IFLA and IPA believe that the time is right for the debate to develop, as hypotheses and speculation can gradually be enhanced by case-by-case experience and empirical data. The debate should be conducted in an open-minded way, encouraging experimentation and arguments based on empirical facts and following the principles of academic discourse.

IFLA and IPA share a common set of basic understandings and believe that the observance of the shared ground as set out below would enhance the overall debate.

1. IFLA and IPA value the contribution to scholarly communication that publishers and libraries have made and believe that mutual respect is important to enhance the quality of the public discourse on open access.
2. IFLA and IPA recognise that the concerns of academic authors must be at the heart of this debate - their scientific freedom, and their needs as researchers, teachers, authors, reviewers and users are paramount.
3. IFLA and IPA acknowledge that the broadest possible access to scholarly communications is an important shared objective and that potential access to all research by all researchers, irrespective of geographical location or institutional affiliation is a shared aspiration of libraries and publishers.
4. All assumptions surrounding open access and scholarly communications should be open to scientific scrutiny and academic debate. All stakeholders are encouraged to innovate, experiment and explore the new opportunities that technology brings.
5. IFLA and IPA recognise that access must be sustainable, i.e. that economic long-term viability and long-term archiving are important elements of this debate.
6. IFLA and IPA agree that the debate is most effective if it recognises the potential diversity of scholarly communication in different academic disciplines and different types of publications, e.g, research journals, review journals, monographs, text books, etc. IFLA and IPA support a debate that avoids general conclusions for all scholarly communication but gives a closer, differentiated focus on the potentially very different framework in various academic disciplines and types of publications.
7. Equally, scholarly publishers and their specific roles and functions can vary greatly. Scholarly publishing includes publishers with a variety of commercial and non-commercial affiliations and interests, outside and within the research community.
8. IFLA and IPA believe publishers, librarians, government and funding agencies should at this stage support innovation, experimentation and pilot schemes on access to scholarly publications. Pilot schemes should be accompanied by vigorous research and analysis that enables evaluation against measurable targets, that reflect the chief concerns of academic authors (as set out in Point 2), as the basis for an enriched, fact-oriented debate. As part of investigating the feasibility of open access, studies should also explore such matters as impact, transparency and economic models. Data should be shared openly among stakeholders or disclosed to allow open scrutiny. The results from these studies should provide better insight into the processes surrounding open access.

The Subcommittee on Courts, the Internet, and Intellectual Property of the House of Representatives' Judiciary Committee in the US is scheduled to hold a hearing on September 11. According to media reports, the move is seen to be a legislative attempt to redress publishers' concerns that public access policies - the recently enacted policy at the National Institutes of Health (NIH) - conflict with copyright and intellectual property laws. No text has yet been released for the legislation, tentatively titled the ‘Fair Copyright in Research Works Act.’ Also, the hearing has not appeared on the subcommittee's schedule.

The legislative hearing follows the success of publishers in adding a key phrase to the NIH public access mandate just before the bill’s passage in December 2007. The added clause calls for the NIH policy to be implemented ‘in a manner consistent with copyright law.’ In recent months, the possibility of a legal or legislative challenge began to seem almost certain. In comments to the NIH on implementation this spring, the Association of American Publishers (AAP) included a legal memo backing publisher claims that the NIH policy conflicts with copyright law. In June, NIH director Elias Zerhouni denied publishers’ request that the policy go through a federal rulemaking process.

Shortly after passage of the NIH public access policy, AAP’s VP for legal and government affairs Allan Adler reiterated the publishers’ position that the measure was ‘unprecedented’ and ‘inconsistent’ with intellectual property laws. It was vowed that publishers would continue opposition. Anticipating such a challenge, officials at SPARC and the Association of Research Libraries, however, have strongly denied that the NIH public access policy conflicts with copyright. Last year, they prepared a memo of their own in this regard.

As a service to its authors, GENETICS deposits its final, published articles to PubMed Central on behalf of its US National Institutes of Health (NIH)-funded authors. The NIH Public Access Policy requires “scientists to submit final peer-reviewed journal manuscripts that arise from NIH funds to the digital archive PubMed Central...To help advance science and improve human health, the Policy requires that these papers are accessible to the public on PubMed Central no later than 12 months after publication.” In support of open access, GENETICS’ published ahead of print articles are freely available within one week of acceptance. All journal content is freely available six months after publication, allowing full compliance with NIH Public Access Policy NOT-OD-08-033. No action is required of GENETICS’ authors.
